The Government has not yet announced any timetable for this, but the Government is launching a review that could well see some small companies excluded from stringent employment laws.
On the face of it, this could be good news for employers, as they would have greater flexibility in dealing with problematic employees who have been with them for less than two years.
However, as most employers will know, a disgruntled employee usually finds a way to bring a claim, and typically, employees who have currently been employed for less than one year, try to get round this legislation by bringing in an allegation of discrimination, as there is no qualifying period necessary to bring a claim of discrimination. Discrimination claims are typically more complex and costly to defend than a simple unfair dismissal claim.
The Government is also considering introducing a fee for lodging claims at the employment tribunal, which would hopefully sort the serious litigants from those who are simply trying their arm and used in conjunction with the above may provide some relief for employers.
