Mr Dansie brought a claim against the Metropolitan Police when he was asked to cut his shoulder length hair by his employer, stating that this amounted to sex discrimination on the basis that a female employee would not have been required to cut her hair.
The EAT found that this did not amount to discrimination or harassment under the Sex Discrimination Act, provided that the overall general dress code was applied equally to both sexes.
The EAT said that the correct legal test in these circumstances was whether, having regard to general standards and conventions, and the specific needs of the profession, the dress code on the whole required an equivalent amount of smartness in appearance by both sexes. The EAT found that the Metropolitan Police Forces dress code was equally balanced, and as such they had not discriminated against Mr Dansie. As such, his Claim was dismissed.
