During December 2008 a self-employed labourer fell 18 metres from a roof down an unguarded light well, resulting in broken bones in his back, a broken arm, pelvis and rib, a punctured lung and internal injuries. He has so far been unable to return to work.
The project on which the accident victim worked was one of restoration at Abingdon Villas in Allen Road, Kensington, London, its Principal Contractor, Triton Building Restoration Ltd.
Triton had subcontracted the restoration of a cast iron fire escape and external repair and painting to Fire Escape Ltd. An HSE official commented that 'companies should ensure that safety precautions to prevent falls from height are monitored to ensure that they are not removed where access to work at height is still possible'.
Triton Building Restoration Ltd of Merton admitted breached s. 3 (1) of the Health and Safety at Work etc Act 1974 and was fined £5,000 plus £11,339 costs. Fire Escape Ltd of Croydon admitted breaching s. 3 (1) of the Health and Safety at Work etc Act 1974 and was fined £3,500 plus £11,300 costs.
