HR Advice For A Difficult Employee

One of the unique aspects of the service we offer is that we can be on hand to provide HR advice with every step of the way and provide representation should your case go to an employment tribunal, as was the case with one of our clients based in Cheshire.

They had been having problems with one particularly difficult employee who was disrupting the workforce, in turn creating a negative working environment. By providing the Company with sound HR advice throughout, we guided them through the disciplinary process for the relevant employee. This situation became more difficult when the employee in question raised several grievances. A lot of care had to be taken to ensure the Company did not discriminate or confuse the grievance and disciplinary procedures, ensuring they were completely fair and impartial, something which we helped them to achieve.

The employee then resigned and subsequently brought a claim to the Employment Tribunal, on the grounds of discrimination and harassment. As we had already been providing Employment Law and HR advice throughout the entire process, we were already familiar with the case and all the documents, ensuring that we could advise the Cheshire-based Company on the best option for them to take commercially. Fortunately, we were able to settle the case, saving both time and money for the Company.

A primary school based in London approached us; budget cuts meant that regrettably, it put several teachers at risk of redundancy. The school’s Governing body wanted HR advice and HR support for the duration of the redundancy process.

Redundancies are always difficult, but we tried to make the process as smooth as possible, as we recognise the exceptional needs and pressures of a school.

We gave pragmatic advice, entwined with a mixture of Employment Law and HR support, ensuring that the process was compliant with statutory and local authority procedures. We were on hand every step of the way, via phone and e-mail: from the initial difficult decision to make redundancies, right through to the end of the process.

We also provided on-site HR support to the school in London, during the consultation process, ensuring that we were available to deal with any queries that arose in the group consultation sessions.

Fortunately, several staff members agreed to take a reduction in their contracted hours, limiting the number of compulsory redundancies that had to be made. Crucially for the Governing body, this meant that the school was able to meet its budget deficit.

If not managed correctly, redundancies can have a detrimental effect on staff morale, but luckily for this London school, with our specialist HR support and Employment Law advice, all staff members were kept fully informed every step of the way, allowing them to remain focused on what really matters: the children and providing them with quality education.

The Managing Director of an Office Fit-out company in Stoke-on-Trent approached us for some expert Employment Law Advice as one of his competitors had recently hired a few members of his sales team from under his nose. Obviously, being concerned (not to mention angry!) that they would most likely have taken their lists of contacts and valuable databases with them to the competitor, he wanted to know if there was anything he could do about it.

Straight away our Lawyers reviewed his Contracts of Employment to find they were 9 years old, with no restrictive covenants or confidentiality clauses included. This left us very little we could do for the employees who have already gone to the competitor. However, we did a full redraft of the firm’s businesses Contracts of Employment & Employee Handbook to include water-tight clauses to cover him from any further instances of this nature in the future.

We advised the Director of how to get his current employees over to the new Contracts thus protecting his business from prying competitors trying to get the upper hand on his business. The moral of the story? Even when damage has been done that no amount of employment law expertise can undo, there are always valuable lessons than can be learned and – more importantly – real, effective measures that can be taken to avoid such damage reoccurring.
